DARKAN TECHNOLOGIES S.L. offers you an online purchasing service that will allow you to contract some of the available services from your device.

Access to the website by users is free of charge. However, some of the services and content offered by DARKAN TECHNOLOGIES S.L. or by third parties linked through the website may be subject to prior user registration in the manner determined in the corresponding Contract Conditions, which will be made available to the user in a clear manner.

Information about the services

You acknowledge our full ownership of each and every intellectual property right over the products, materials or content appearing on the Website.

Special offers, promotions or discounts will be valid until the date indicated or while supplies last.

NOVA CONNECT makes every effort to ensure that the information contained on the Website is complete, truthful and correct. If there is an error in any data, NOVA CONNECT will proceed to rectify it.

In order to be an active user of this website, you must be at least 16 years old, however, minors may not purchase products or services.

Purchase procedure

The services you wish to purchase must be selected and added to the shopping bag by clicking on the corresponding icon.

The shopping bag will contain the reference of the selected service, its price, in the corresponding currency (taxes included).

Your personal data will be treated in accordance with the principles of transparency, purpose limitation, data minimization, accuracy, integrity and confidentiality, as well as respecting the rest of the obligations and guarantees established in Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and the free circulation of these data and in Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights. NOVA CONNECT reminds you that you must provide your personal details accurately to avoid confusion or incidents in the management of the service purchased.

Before making the contract, the customer will be presented with a summary of the same identifying the service added to the shopping cart, its total price (taxes included) with each of the concepts broken down so that the customer can confirm it by clicking on the button with the expression ‘Confirm payment’.

If before confirming the payment you detect an error in the contract, you can modify any detail of it by clicking on the ‘Edit’ or ‘Delete’ button. If you detect an error in the contract once the payment process has been completed, please contact us.

Once the service has been contracted, the order number will be communicated through the Website itself so that the client can, at any time and from their device, track the order.

The receipt of the aforementioned order acknowledgement does not mean acceptance of the order by NOVA CONNECT. The client's order constitutes an offer to NOVA CONNECT to contract the service. All orders are subject to acceptance by NOVA CONNECT.

NOVA CONNECT is not obliged to accept the order and may, at its discretion, deny its acceptance. The client, however, acknowledges that by clicking on the "Confirm payment" button, they acquire the obligation to pay for the service when NOVA CONNECT accepts the order. The contract between the client and NOVA CONNECT in relation to the requested service will be deemed to be concluded when NOVA CONNECT sends the client its Confirmation. The Contract will only relate to the service that has been confirmed in the Confirmation. NOVA CONNECT will not be obliged to supply any service that has not been confirmed.

Service availability

All orders are subject to service availability. If service availability is not possible, the customer will be notified immediately. In addition, the amount charged for the service that is not available will be paid to the customer in the following days, using the same payment method used for the purchase.

Your account

Some of the Services require you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You will also choose a password and user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are solely responsible for any and all activities that occur under your account.

You agree to notify NOVA CONNECT immediately of any unauthorized use of your account or any other breach of security. NOVA CONNECT will not be liable for any loss you may incur as a result of someone else using your password or account, with or without your knowledge. However, you may be liable for losses incurred by NOVA CONNECT or another party due to someone else using your account or password. You may not use another person's account at any time without the permission of the account holder.

Once registered, you will be able to access different services and features of the website, such as the following:

• Purchase the products or services offered on the website.

• Modify your user profile.

Right to refuse a service request

NOVA CONNECT may cancel any Confirmed order or not accept an order placed for the following reasons:

1. In the event of a technical error and/or a typographical error in the prices or other product data contained on the Website when the order was placed.

2. Due to lack of availability as described in the previous point.

3. When the security systems indicate that the order may be fraudulent.

4. When there are reasons that indicate that the customer is a minor.

5. When NOVA CONNECT has not been able to deliver the order to the address provided by the customer.

6. When there is a computer attack, virus or any event that is beyond the reasonable control (force majeure) of NOVA CONNECT.

In such cases, NOVA CONNECT will fully refund the amounts that have been subscribers.

Price and payment

Payment and currency

Prices on this Website are shown in Euros. Prices for services may change at any time, but any changes will not affect orders for which NOVA CONNECT has sent the customer confirmation.

VAT

All prices for services listed on this Website include VAT at the rate in force at any given time. For deliveries to the Canary Islands, Ceuta and Melilla, the corresponding taxes and duties will apply in accordance with the regulations in force in each of these territories.

Payment methods

NOVA CONNECT will accept payments made via credit or debit card, Google Pay and Apple Pay.

Payment by credit or debit card

NOVA CONNECT accepts payment for purchases made through the Website with the following credit or debit cards: Visa, Visa Electron, MasterCard and American Express.

If the payment method chosen by the customer is a credit or debit card, the charge will be made online, that is, in real time, through the payment gateway of the corresponding financial institution, once it has been verified that the data provided is correct.

Payment security

In order to provide maximum security to the payment system, NOVA CONNECT uses secure payment systems from leading financial institutions in e-commerce. In this sense, confidential payment data is transmitted directly and in encrypted form (SSL) to the corresponding financial institution. When making the payment through the secure payment gateway, the system will connect with the issuing bank, which will request that you authorize the operation using a personal authentication code. The operation will only be carried out if the bank issuing the credit card confirms the authentication code. Otherwise, the transaction will be rejected. We also have the SSL online transaction security certificate.

Assignment and waiver of rights

The client may not transmit, assign or transfer a contract or any of the rights or obligations derived from it without having previously obtained the written consent of NOVA CONNECT.

No waiver by NOVA CONNECT of a right to a specific action derived from this contract will constitute a waiver of other rights or actions unless it is communicated expressly and in writing.

Right to modify these conditions

NOVA CONNECT may modify these conditions at any time without, under any circumstances, retroactive application.
